Acceptance of Terms

By accessing the website, requesting an estimate, scheduling services, using the customer portal, submitting an intake form, or otherwise using JCTX Lawn Care services, you agree to these Terms and Conditions.

SMS consent is governed by the separate SMS-specific provisions below and is not automatically granted merely by using the website or requesting service.

Services

JCTX Lawn Care provides lawn care, landscaping, property maintenance, cleanup, and related services. Service availability, scheduling, pricing, scope, and frequency may depend on:

• Property location
• Property size and condition
• Requested service
• Crew availability
• Weather
• Access conditions
• Customer-provided information
• Written estimate or service agreement

Website content and preliminary discussions do not constitute a final quote unless JCTX Lawn Care issues a written estimate or agreement.

Estimates and Quotes

Estimates may be based on customer-submitted information, photographs, property details, site visits, measurements, or third-party property data. Estimates may be revised if:

• Property conditions differ from the information provided
• Additional labor or materials are required
• Access is restricted
• Hidden debris, excessive growth, hazards, or special disposal needs are discovered
• The requested scope changes

A quote is not binding until accepted according to the instructions provided with the quote.

Scheduling and Service Changes

Service dates and time windows are estimates and may change because of:

• Weather
• Equipment issues
• Crew availability
• Route changes
• Safety conditions
• Property access
• Events outside the company's reasonable control

Customers may request rescheduling or cancellation through the website, customer portal, phone, or text message.

Any applicable cancellation terms will be shown in the customer's estimate, agreement, invoice, or service plan.

Customer Responsibilities

Customers are responsible for:

• Providing accurate contact and property information
• Providing safe and reasonable property access
• Unlocking gates when required
• Securing pets
• Removing fragile or valuable items
• Identifying hazards, irrigation components, invisible fencing, wiring, drains, septic components, or other concealed property features
• Providing any required access instructions
• Informing JCTX Lawn Care of material changes before service

Payments and Invoices

Pricing, payment schedules, accepted payment methods, deposits, recurring billing, and due dates are governed by the applicable estimate, invoice, subscription, or service agreement.

Customers authorize only the charges they affirmatively approve. This page does not collect or display full payment-card information.

SMS Consent and Privacy

Mobile phone numbers, SMS consent records, and opt-in data will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be shared with service providers, including communications, hosting, customer-management, scheduling, billing, and technology providers, only as reasonably necessary to operate the requested services and communications.

How Customers Opt In

Website and intake-form opt-in

• The customer completes a public contact, quote-request, or service-intake form.
• The customer is presented with a separate text-message consent choice.
• The consent option is not preselected.
• The customer may decline SMS consent.
• The form records the customer's selection.
• SMS messages are sent only after affirmative consent.

Inbound SMS

When a customer independently sends a text message to JCTX Lawn Care, the business may respond to that inquiry. Continued automated or recurring communications require consent appropriate to the message type.

How Customers Opt Out

Customers may opt out of SMS messages by replying STOP. Standard opt-out variations may also be recognized by the messaging provider, but STOP is the primary published opt-out instruction.

Customers can also request removal by contacting JCTX Lawn Care through the contact page or by phone.

Help and Customer Support

Customers may reply HELP for assistance.

Communications Service Providers

JCTX Lawn Care may use third-party service providers, including SimplyLawn CRM and telecommunications providers, to deliver texts, calls, intake forms, scheduling updates, customer support, and related operational communications.

Use of those providers does not authorize the sale or sharing of SMS consent for third-party marketing.

Intellectual Property

The website, logos, branding, text, graphics, forms, and software-related content are owned by or licensed to JCTX Lawn Care and may not be copied or reused without permission, except where law permits.

Prohibited Use

Users may not engage in:

• Misuse of the website
• Fraudulent submissions
• Unauthorized access
• Interference with website operation
• Malicious code
• Impersonation
• Harassment or abuse
• Use of services for unlawful purposes

Disclaimer of Warranties

The website and online features are provided on an "as available" basis and may occasionally be unavailable. Nothing in these Terms attempts to disclaim obligations that cannot legally be disclaimed.

Limitation of Liability

To the extent permitted by law, JCTX Lawn Care is not liable for indirect, incidental, special, or consequential damages arising solely from website or messaging-system use.

Nothing in these Terms limits liability where limitation is prohibited by law, including rights or responsibilities that cannot legally be waived.

Indemnification

Users may be responsible for losses caused by their unlawful use of the website, fraudulent submissions, or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Texas. Venue, where applicable, will lie in a court of competent jurisdiction serving Jefferson County, Texas, unless applicable law requires otherwise.

Changes to These Terms

These Terms may be updated from time to time, and the Effective Date will be revised when updates are published. Material changes to SMS terms will be presented through an appropriate notice or renewed consent where required.
